Decree No. 3/2006. (I. 19.) of the Minister of
the Interior
on establishing the procedure deadlines and dates of the parliamentary elections
scheduled at 9 and 23 April 2006
By virtue of my authority based on section b) paragraph (1) article 153 of the act No. C of 1997 on the election procedure (hereinafter: the Act) I determine the calendar deadlines and dates of the parliamentary elections set by the President of the Republic at the 9th day of April and on the 23rd day of April 2006 as follows:
Registration of voters
1. § (1) The advice on including in the electoral rolls
should be sent out to the voters together with the coupon of recommendation
between 6 February and 10 February 2006 [para (1) art. 14 of the Act].
(2) The electoral roll should be made accessible for the public from 8 February
to 15 February [para (1) art. 14 of the Act].
(3) Objections concerning exclusion and cancellation from or inclusion in the
electoral roll can be submitted from 8 February until 16.00 o'clock on 15
February 2006 [para (1) art. 20/E of the Act].
(4) The voter can request inclusion in the electoral roll of a foreign
representation from the head of the local electoral office according to his/her
domicile (hereinafter: LEO) until 16.00 o'clock on 17 March 2006 [para (1) art.
89/B of the Act].
(5) The head of the LEO shall forward the contents of the foreign
representation's roll until 16.00 o'clock on 24 March 2006 to the National
Electoral Office (hereinafter: NEO) [para (5) art. 89/B of the Act].
(6) Excuse - for the first and the second ballot alike - can be requested
personally or though proxy until 16.00 o'clock on 7 April 2006, or in a
registered letter so as it arrives on 4 April 2006 the latest to the electoral
office. Excuse - for both the first and the second ballot- can be issued until
16.00 o'clock on 7 April 2006 the latest [para (4) art. 89 of the Act].
(7) The amended electoral roll can be inspected until 16.00 o'clock on 7 April
2006 and until 16.00 o'clock on 21 April in the mayor-'s office [para (3) art.
15 of the Act].
The electoral roll cannot be amended because of change in the home address after
8 April 2006 ) [art. 89/A of the Act].
Setting up of the electoral bodies
2. § (1) The members of the National Electoral Office (hereinafter:
NEC), the regional electoral committee and of the electoral committee of the
parliamentary individual constituency (hereinafter: PIEC) should be elected on
17 February 2006 the latest [para (5) art. 23 of the Act].
(2) The elected members of the returning boards (hereinafter: RB) and the
required number of their substitutes should be elected on 20 March 2006 the
latest [para (1) art. 23 of the Act].
(3) The assigned members of the returning boards can be registered by the
organization having set up candidate and/or list or by the independent candidate
on 31 March 2006 the latest [para (2) art. 25 of the Act].
The election campaign
3. § (1) The head of the LEO shall hand out a copy of the
electoral roll accessible for inspection upon the request of a candidate of the
nomination committee [para (2) art. 45 of the Act].
(2) The central office of personal information and home address registration
shall hand out the first and the second names as well as the home addresses from
21 March 2006 upon the request of the nomination organizations [para (1) art. 45
of the Act].
(3) The national public broadcasting media shall publish the political
advertisements of the nomination organizations setting national list, the
district public broadcasting media shall publish the political advertisements of
the nomination organizations setting lists in their reception territory, and the
local public broadcasting media shall publish the political advertisements of
the individual constituency's candidates running in their reception territory
from 22 March to April 6 and from 10 April to 20 April 2006 at least once free
of charge [para (1) art. 93 of the Act].
(4) The broadcasting media referred to in paragraph (3) shall publish the
political advertisements prepared by the nomination organizations or by the
candidates on 7 April and on 21 April 2006 at least once free of charge [para
(2) art. 93 of the Act].
(5) The results of the election-related public opinion research must not be made
public from 1 April until 19.00 o'clock on 9 April 2006, and from 15 April until
19.00 o'clock on 23 April 2006 [para (1) art. 8 of the Act].
(6) The election campaign shall last until 24.00 o'clock on 7 April 2006, and
from 19.00 o'clock on 21 April 2006 [para (1) art. 40 of the Act].
(7) It is forbidden to conduct any campaign from 00.00 o'clock on 8 April 2006
until 19.00 o'clock on 9 April 2006, and from 00.00 o'clock on 22 April 2006
until 19.00 o'clock on 23 April 2006 [para (2) art. 40 of the Act].
(8) The information included in the data supply performed as per paragraphs (1)
and (2) should be destroyed on 23 April 2006 the latest [para (3) art. 45 of the
Act].
(9) The posters should be removed by those placed or by those interested in
their placement until 23 May 2006 [para (6) art. 42 of the Act].
(10) The nomination organizations and the independent candidates should account
on 23 May 2006, the latest, with the utilization of the budget subsidy got from
the budget for the purposes of the elections in the place where the subsidy was
paid out [para (4) art. 91 of the Act].
(11) Every nomination organization and the independent candidate should publish
in the Hungarian Gazette the funds, amounts of financial supports, their sources
and way of utilization got from the state budget and from other sources by 22
June 2006, the latest [para (2) art. 92 of the Act].
(12) The National Audit Office shall control by 23 April 2007 the utilization of
the funds got from the state budget or from other sources and spent on the
elections ex officio in relation with the nomination organizations and
independent candidates having got parliamentary mandates, and upon the request
of other candidates or nomination organizations in relation with other
nomination organizations and independent candidates. Request for control can be
submitted until 24 July 2006 [para (3) art. 92 of the Act].
Nomination
4. § (1) The electoral offices shall run the IT control
system for candidate recommendation from 10 February 2006 [section f) para (1)
art. 38 of the Act].
(2) Candidates can be recommended until 16.00 o'clock on 17 March 2006 [para (3)
art. 46 of the Act].
(3) Candidates can be announced to the competent electoral committee until 16.00
o'clock on 17 March 2006, the latest [para (1) art. 52 of the Act].
(4) The recommendation coupons not submitted should be destroyed by 16.00
o'clock on 20 March 2006. The related records should be handed over to the
electoral committee 16.00 o'clock on 23 March 2006 [art. 60 of the Act].
(5) The regional list and the candidates included in them can be announced by
16.00 o'clock on 20 March 2006, the latest [para (1) art. 94 of the Act].
(6) The national list and the candidates included in them can be announced by
16.00 o'clock on 21 March 2006, the latest [para (1) art. 94 of the Act].
(7) If the voter has been recommended for candidate in more than one place
within the same type of nomination, he/she should declare by 16.00 o'clock on 21
March 2006, the latest, which nomination he/she accepts [art. 57 of the Act].
(8) The combination of lists, the sequence of lists, and the sequence of getting
mandates by the candidates included in the combined lists can be announced by
16.00 o'clock on 22 March 2006 [para (1) art. 95 of the Act].
(9) The distribution of the fragmentary votes o joint candidates and the joint
regional lists can be announced by 16.00 o'clock on 22 March 2006 [para (3) art.
95 of the Act].
(10) The competent electoral office shall destroy the recommendation coupons as
well as the technical registration on 9 April 2006 [para (3) art. 59 of the Act].
Voting at foreign representations
5. § (1) The nomination organizations and the independent
candidates can announce the foreign representation observers to the NEC by 16.00
o'clock on 24 March 2006 [para (4) art. 87 of the Act].
(2) In the first ballot, votes can be cast between 6.00 and 19.00 o'clock local
time on 2 April 2006. At foreign representations where time lag is -1 or -2
hours in relation to the Central European time, votes can be cast between 6.00
o'clock local time and 19.00 Central European time. At foreign representations
on the American continent, votes can be cast between 6.00 and 19.00 o'clock by
local time on the 8th day preceding the ballot in Hungary [para (1) art. 96/A of
the Act].
(3) In the second ballot, votes can be cast between 6.00 and 19.00 o'clock local
time on 23 April 2006. At foreign representations where time lag is -1 or -2
hours in relation to the Central European time, votes can be cast between 6.00
o'clock local time and 19.00 Central European time. At foreign representations
on the American continent, votes can be cast between 6.00 and 19.00 o'clock
local time on the day preceding the ballot in Hungary [para (5) art. 71/A of the
Act].
Consolidation of votes
6. § (1) The ballot box containing the ballot papers cast
should arrive to the NEO in the first ballot by 24.00 o'clock on 6 April 2006 [para
(1) art. 96/B of the Act].
(2) One copy of the ward records can be inspected in the competent electoral
office until 16.00 o'clock on 12 April 2006 and until 16.00 o'clock on 26 April
2006 [para (2) art. 75 of the Act].
(3) In the first ballot, the competent electoral committee shall consolidate the
votes on the basis of the records of the returning boards on 10 April 2006, the
latest, and establish the conclusion of the elections [para (3) art. 73 of the
Act].
(4) The ballot box containing the ballot papers cast at the foreign
representations should arrive to the NEO in the second ballot by 24.00 o'clock
on 27 April 2006 [para (2) art. 71/C of the Act].
(5) In the second ballot, the PIEC shall hand over the ward ballot boxes and the
envelopes containing the ballot papers collected by the foreign representations
to the designated RB on 29 April 2006 [para (4) art. 97/A of the Act].
(6) The ballot papers should be retained in the mayor's office by 22 July 2006.
The ballot papers and the electoral documents - except for the records - should
be destroyed after 22 July 2006. [para (3) art. 75 of the Act].
(7) The first copy of the records should be handed over to the competent
archives following 22 July 2006. [para (4) art. 75 of the Act].
(8) If the ballot box does not arrive to the NEO by the deadline set in
paragraph (4) or in the way specified in para (1) article 71/C of the Act, then
the documents of the foreign representations, including the intact ballot box,
should be destroyed without opening it after 22 July 2006. [para (3) art. 71/C
of the Act].
7. § This decree shall come into force on the day of its promulgation,
and simultaneously with this the text "in sizes A/3 and A/4" in section c)
article 6; the text "in size A/4" in section g) article 10; and the text "designed
at size A/3 to facilitate printing" in section c) para (2) article 13 of the
decree No. 60/2005. (XII. 21.) BM on the execution of the act No. C of 1997 on
the electoral procedures at the parliamentary elections will be repealed.
