Election information for the blind and sight-impaired people Main Page / Law / Acts Act 4 of 1978on the Criminal Code(abstract issue)Chapter 15Criminal offence against the fairness of public administration, administration of justice and public lifeCriminal offence against the order of elections, referendums and popular initiatives211. § Anyone who in the course of elections, referendums or popular initiatives subject to the Act on Electoral Procedure a) violating the rules of nomination, gains proposals with force, threatening, fraud or pecuniary allowances, b) in order to propose a referendum or popular initiative, gains signatures with force, threatening, fraud or pecuniary allowances, c) votes without title, d) signs illegally, indicates false data, e) hinders persons entitled to do so from electing, or voting on a referendum, or attempts to influence such persons with force, threatening, fraud, or pecuniary allowance, f) violates the secrecy of the elections or referendums, g) falsifies the results of the elections, referendums or popular initiatives, shall commit a crime, and may be sentenced to maximum three years' imprisonment. Chapter 17Economic crimeCriminal offence against information technology system and data300/C. § (1) Anyone who enters an information technology system without authorisation by violating or getting round measures that protect such information technology system, or, exceeding or violating the limits of their title, remain there, shall commit an offence, and shall be sentenced to maximum one year's imprisonment, to do community work or to pay penalty. (2) Anyone who a) illegally change, delete or make inaccessible data stored, processed, handled or transmitted in an information technology system, b) illegally hinder the operation of an information technology system by entering, transmitting, changing, deleting data or by performing other operations, shall commit an offence and shall be sentenced to do community work or to pay penalty. (3) Anyone who for the sake of illegal gains a) enter data in an information technology system, change, delete or make inaccessible data stored, processed, handled or transmitted, or b) hinder the operation of an information technology system by entering, transmitting, changing, deleting data or performing other operations, and cause damage by it, shall commit a crime, and shall be sentenced to maximum three years' imprisonment. (4) The punishment of the crime determined in paragraph (3) shall be a) minimum one, maximum five years' imprisonment, if the computer fraud causes substantial damage, b) minimum two, maximum eight years' imprisonment, if the computer fraud causes specially great damage, c) minimum five, maximum ten years' imprisonment, if the computer fraud cause specially substantial damage.
