of the Minister of the Interior
on determining the procedural terms and deadlines of the election of the Members of the European Parliament called for 13 June 2004
On the grounds of the authorisation pursuant to clause b) paragraph (1) of Article 153 of Act C of 1997 on Electoral Procedure (hereinafter referred to as “Procedural Law”), I shall determine the terms and deadlines calculated according to calendar days of the election of the Members of the European Parliament called by the President of the Republic for 13 June 2004 as follows:
Registration of suffrage
1. §
(1) The notice on having been entered in the register together with the proposal coupon shall be sent to voters between 13 April and 16 April 2004 [Paragraph. (1) § 14 Procedural Law]
(2) The register shall be displayed publicly from 14 April to 21 April 2004. [Paragraph (1) § 14 Procedural Law]
(3) Reserves may be submitted because of having been omitted from or entered in the register from 14 April to 04:00 p.m. 21 April 2004 [Paragraph (1) § 82 Procedural Law]
(4) Before 4 May 2004, the head of the local election office shall, on the strength of application, enter citizens of other Member States of the European Union in the register, if they are not included in the register of voters of legal age that have been disfranchised. [Paragraph (3) § 99/D Procedural Law]
(5) Before 10 May 2004, the head of the local election office shall forward the particulars of citizens of other Members States of the European Union registered to the Central Office of the Ministry of the Interior. [Paragraph (5) § 99/D Procedural Law]
(6) Before 14 May 2004, voters may request of the head of the local election office of their address personally or through a delegate having an authorisation enshrined in a private deed with conclusive force that they should be entered in the register at foreign representations. Inclusion in the register at foreign representations may be requested also by registered mail in such fashion that the letter shall have been received by the local election office the latest before 14 May 2004. (7) Before 23 May 2004, the head of the local election office shall send the data of the register at foreign representations to the National Election Office. [Paragraph (3) § 99/J Procedural Law]
(8) Before 04:00 p.m. 29 May 2004, the members and alternate members of ballot counting committees operated at foreign representations may request of the head of the local election office that they should be entered in the register at foreign representations. [Paragraph (9) § 99/K Procedural Law]
(9) Before 4 June 2004 the head of the local election office shall inform the National Election Office about the members and alternate members of ballot counting committees operated at foreign representations additionally entered in the register at foreign representations. [Paragraph (4) § 99/J Procedural Law]
(10) Certificates may be applied for either personally or through a delegate before 04:00 p.m. 11 June 2004, and by registered mail in such fashion that the letter shall have been received by the election office before 8 June 2004. Certificates may be issued the latest before 04:00 p.m. 11 June 2004. [Paragraph (4) § 89 Procedural Law]
(11) The modified register may be inspected before 04:00 p.m. 11 June 2004 at the mayor’s office. [Paragraph (3) § 15 Procedural Law]
(12) On 14 June 2004, the Central Office of the Ministry of the Interior shall cease the register of the data taken over pursuant to § 48 EP Election Act and delete such data. [Paragraph (6) § 48 EP Election Act]
Establishing election bodies
2. §
(1) Before 04:00 p.m. 14 May 2004, the members and alternate members of parliamentary single mandate constituency election committees and local election committees of settlements having several electoral districts who were elected for the 2002 parliamentary elections and local elections may apply to the National Election Committee for reserve of members or alternate members of ballot counting committees operated at foreign representations. (2) The National Election Committee shall put forward a proposal for the members and alternate members of ballot counting committees operated at foreign representations to the Parliament before 19 May 2004. [Paragraph (5) § 99/K Procedural Law]
(3) Delegated members of ballot counting committees operated at foreign representations shall be notified before 04:00 p.m. 21 May 2004 to the Chairman of the National Election Commission. [Paragraph (7) § 99/K Procedural Law]
(4) The three members and the alternate member of ballot counting committees operated at foreign representations shall be elected by the Parliament before 24 May 2004. [Paragraph (6) § 99/K Procedural Law]
(5) Delegated members of election committees may be notified by nominating organisations setting up a list the latest before 04:00 p.m. 28 May 2004 [Paragraph (2) § 25 Procedural Law]
Proposal
3. §
(1) Lists and candidates included in the lists shall be notified the latest before 04:00 p.m. 14 May 2004 by delivering proposal coupons to the National Election Committee. [Paragraph (2) § 99/L Procedural Law]
(2) Proposal coupons not submitted shall be annihilated before 04:00 p.m. 17 May 2004. The minutes made of this shall be delivered before 04:00 p.m. 20 May 2004 to the election committee. [§ 60 Procedural Law]
(3) Proposal coupons and technical registers shall be annihilated by the competent election committee on 13 June 2004. [Paragraph (3) § 59 Procedural Law]
Election campaign
4. §
(1) The election campaign shall last until 12:00 p.m. 11 June 2004. [Paragraph (1) § 40 Procedural Law].
(2) No campaign shall be pursued from 0:00 a.m. 12 June to 07:00 p.m. 13 June 2004. [Paragraph (2) § 40 Procedural Law]
(3) The results of public opinion polls related to the elections shall not be published from 5 June to 7:00 p.m. 13 June 2004. [Paragraph (1) § 8 Procedural Law]
(4) The Central Office of the Ministry of the Interior shall deliver the first name and family name and address of voters included in the register to candidates, nominating organisations, at their request, from 25 May 2004. [Paragraph (1) § 45 Procedural Law]
(5) The copy of the register publicly displayed shall be delivered by the head of the local election office at the request of candidates, nominating organisations from 25 May 2004. [Paragraph (2) § 45]
(6) The data supplied pursuant to paragraph (4) and (5) shall be annihilated the latest before 04:00 p.m. 13 June 2004. The minutes made thereof shall be handed over to the supplier of such data before 04:00 p.m. 16 June 2004. [Paragraph (3) § 45]
(7) Posters shall be removed by those who have placed them or on behalf of whom they have been placed before 13 July 2004. [Paragraph (6) § 42 Procedural Law]
Voting
5. §
(1) It is possible to vote in the territory of the Republic of Hungary from 06:00 a.m. to 07:00 p.m. on 13 June 2004. [Paragraph (1) § 61 Procedural Law]
(2) At foreign representations, it is possible to vote between 6 a.m. and 7 p.m. local time, on the day of voting in Hungary. At foreign representations where the time difference is one hour compared to Central Europe (Greenwich time zone), it is possible to vote between 6 a.m. local time and 7 p.m. CET. At foreign representations set up on the American continent, it is possible to vote on the day before the day of voting in Hungary between 6 a.m. and 7 p.m.. local time. Aggregating ballots
6. §
(1) A copy of the electoral district minutes may be inspected at the competent election office before 04:00 p.m. 16 June 2004 [Paragraph (2) § 75 Procedural Law].
(2) A copy of the minutes made of the result of the election at foreign representations may be inspected at foreign representations before 04:00 p.m. 16 June 2004. After that the minutes shall be forwarded to the National Election Office. [Paragraph (5) § 99/O Procedural Law]
(3) The ballot papers shall be preserved at the mayor’s office until 11 September 2004. After 11 September 2004, the election documents, except for the minutes, shall be annihilated. [Paragraph (3) § 75]
(4) The minutes shall be handed over to the relevant archives after 11 September 2004. [Paragraph (4) § 75]

This Decree shall come into force on the day it is promulgated.
